Description: Estate’s interest in a judgment awarding debtor payment of a monthly divorce settlement. The payments are a result of a 2015 divorce settlement/agreement. Court File/Index # 15 36094 (CGM) and 15 09023 (CGM); US Bankruptcy Court, State of New York, Poughkeepsie Division. The monthly payments were awarded at $750 per month to begin May 2015. The Divorce Settlement Agreement was dated November 25, 2014.

The Settlement awarded to the former spouse and (now) debtor was for a total of $108,000. Per the Trustee, payments have been routine and on-time. At the time the bankruptcy was filed, the balance due had been reduced to $103,500.

The balance remaining to be paid is $81,750 as of 10/15/17. The payments were ordered to be monthly. The failure to pay any said monthly payment due and the continued default of said payments after ten (10 days) days written notice to the debtor and his counsel by first class mail shall entitle the Trustee to collect the balance due to the estate at the time of said default.

Once the judgment is sold, payments will be redirected to the new owner upon receipt of payment by the winning bidder. The winning bidder does not receive prior payments. Payments transfer on a date as determined by the Trustee.
