The rights have had a variety of lease holders over the past 25 years. The location is in southeast Pleasants County in the Districts of Jefferson, McKim and Washington
The Legal Description is (abbreviated):
‘First Tract, Beginning at a stone at road corner to Cook land; thence with road N 66 W 77 ½ rods to stone, corner to Zadock Dye on the top of hill…………….containing ninety-seven (97) acres, more of less’
“Being the same ½ minerals interest reserved by Roland Dye in Deed Book 74, Page 97, November 5, 1935, and willed to the wife Garnet Dye by will dated, August 5, 1959, recorded in Will Book 11 at page 115. This conveyance is made subject o any and all rights of way, reservations and easements now of record affecting said mineral rights’
The lease operators have included XTO Energy, Tapo Energy, Hamilton Natural Gas Company, and Maxon Energy. There have been past royalty payments to the debtor but the amounts paid are currently unknown. See below related to the debtor’s health.
The original deed references 97 acres. According to the County Assessor, there is natural gas drilling ‘in the area’ of the rights. Oil and gas drilling remains in Jefferson and Washington Districts and neighboring Lafayette and Union Districts
The rights come with a County record and taxes assessed by Pleasants County. The Account # is 13814309, and the Ticket # is 301213. Also, Account # 08-9999-00000748 and the Ticket # is 10931. The deed and leases are recorded in the name of the debtor’s late husband. The County invoices are in the name of the debtor. There is a total due in past due taxes in the amount of $40.24.
The debtor has been in ill health for two years and did not provide forwarding addresses to her investments and leasing contracts. As a result, payments/invoices were returned to the Sender who placed a hold on the account by the leasing firms. For this reason, royalties are unknown through 2016 as payments ceased when USPS mail was returned as undeliverable.
The deed is in the name of the debtor’s late husband and was inherited by the debtor. A copy of the Will and Death Certificate will be provided to the winning bidder for recording with Pleasants County.
